With the introduction of the updated IR35 Off-Payroll legislation into both the Public and Private sector the engagement of what would have traditionally been known as “Contractors” has become somewhat more difficult and the associated risks and procedure need to be addressed at a very early stage of the process.
There is now a requirement to undertake a status determination which is used to determine whether a role you are looking to fill is truly an Off-Payroll role or could be deemed to be a “disguised employee”.
If the role is found to be “out of scope” of the legislation then a day rate can be offered to the candidates and the assignment can be run through their own PSC (Personal Services Company) as a B2B relationship where the contractor is responsible for all deductions of PAYE and NI. All relevant documentation needs to be retained as HMRC could challenge any decision and if they prove “disguised employment” then there is a liability for unpaid taxes and national insurance.
Workers who operate through an “umbrella” company are Off-Payroll and also “out of scope” as the Umbrella company becomes their employer and as such takes the responsibility for deductions of PAYE, both employee and employers National Insurance and any other levies. This allows you to engage a worker for an agreed period of time at an agreed hourly or daily fee in the knowledge that the status of the worker will not be challenged.
